Terms of service

These terms define the rules for accessing and using Nawras for COD merchants, their teams and their workspaces.

1. Acceptance of terms

By accessing and using the Nawras SaaS application, you agree to be bound by these terms of service. If you do not accept these terms, please do not use the service.

2. Service description

Nawras is a multi-tenant SaaS platform dedicated to cash-on-delivery (COD) order management for e-merchants. The service includes order tracking, role-based team management, AI assistant agents, WhatsApp messaging, as well as integrations with carriers and e-commerce platforms.

3. Merchant account and team

Each merchant has an isolated workspace. You can invite team members and assign them roles that define their access. You are responsible for the accounts you create, the permissions you grant and the actions taken by your team within your workspace. Keeping your credentials confidential is your responsibility.

4. Subscription, credits and billing

Nawras operates on a subscription combined with a credit wallet. By subscribing, you agree that:

  • Some actions consume credits, in particular sending a WhatsApp message and using an AI agent; inbound messages are not billed.
  • Consumed credits are non-refundable, and remaining credits may expire according to the terms of your plan.
  • Fees charged by Meta for the use of WhatsApp Business are at your expense and paid directly to Meta, outside of your Nawras subscription.

5. AI agents

Nawras provides AI agents (sales, confirmation, support) to assist with order management. These agents generate automated responses and may make mistakes or produce inaccurate information. You remain responsible for supervising their conversations and validating important decisions, in particular order confirmation, quoted prices and delivery details.

6. WhatsApp and messaging

Sending messages via WhatsApp is subject to Meta's policies and applicable regulations. You agree to message only customers who have agreed to it, to comply with WhatsApp Business commercial policies, and not to send prohibited or unsolicited content. Any block or suspension imposed by Meta is part of your relationship with Meta.

7. Merchant responsibility

As a merchant, you are responsible for:

  • The accuracy of information related to your products, orders and customers.
  • The lawful use of the service and third-party integrations, in compliance with Moroccan regulations.
  • Managing your commercial relationship with your customers, including delivery, cash collection and dispute handling.

8. Your customers' data

As part of your business, you collect and process your customers' data (name, phone number, delivery address). You are the data controller for it; Nawras acts as a processor that hosts and processes this data on your behalf, following your instructions. You are responsible for having a legal basis to collect and use this data, in compliance with Law 09-08 on the protection of personal data.

9. Limitation of liability

Nawras is a management tool: the platform is not a party to the transactions between you and your customers. Nawras cannot be held liable for disputes relating to orders, delivery, cash collection, returns or product quality. Nawras' liability is limited, to the extent permitted by law, to the proper functioning of the platform as described.

10. Service availability

The service is provided "as is" and "as available". We strive to ensure continuous availability but do not guarantee uninterrupted access. We may carry out maintenance, updates or fixes that may temporarily affect access to the service.

11. Termination

You may stop using the service at any time. We may suspend or terminate access in the event of a breach of these terms, fraudulent or abusive use, or non-payment. Upon termination, you may request an export of your data within a reasonable period by contacting us at contact@nawras.ma.

12. Governing law

These terms are governed by Moroccan law. Any dispute relating to their interpretation or performance falls under the jurisdiction of the competent courts of the Kingdom of Morocco, failing an amicable resolution.

13. Changes to the terms

We may modify these terms in order to improve the platform, maintain its security or adapt its features. Changes take effect upon publication. By continuing to use the service after an update, you accept the modified terms.
